Effective Date: 1 January 2025 | Last Reviewed: 1 January 2025

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", "your") and Wanderlust Australia Pty Ltd (ABN 00 000 000 000) ("Wanderlust Australia", "we", "us", "our"), a travel agency registered in New South Wales, Australia.

By accessing our website, submitting an enquiry, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you are booking on behalf of others, you confirm you have authority to accept these Terms on their behalf.

2. Our Services

Wanderlust Australia acts as a travel agent and intermediary. We arrange travel products and services — including flights, accommodation, tours, cruises, car hire, and travel insurance — on your behalf through third-party suppliers. We are not the direct provider of these travel services.

Our services include:

3. Bookings and Payments

3.1 Booking Confirmation

A booking is confirmed once we issue a written confirmation and you have paid the required deposit. Verbal commitments do not constitute a booking.

3.2 Deposits and Final Payment

A non-refundable deposit (amount specified at time of booking) is required to secure most bookings. Final payment is due no later than 60 days before departure, unless otherwise stated in your booking confirmation.

3.3 Pricing

All prices are quoted in Australian Dollars (AUD) unless otherwise stated. Prices are subject to change until your booking is confirmed and deposit paid. We reserve the right to pass on changes in airfare taxes, fuel surcharges, or currency fluctuations where these occur after confirmation.

3.4 Service Fees

Wanderlust Australia charges professional service fees for consultation and booking management. These fees are disclosed at the time of consultation and are separate from supplier costs.

4. Cancellations and Amendments

4.1 Client Cancellations

All cancellations must be submitted in writing to [email protected]. Cancellation fees apply as follows (from date of written cancellation):

Additional cancellation fees may apply from airlines, hotels, and other suppliers. We strongly recommend purchasing comprehensive travel insurance.

4.2 Amendments

Amendment requests are subject to supplier availability and may incur amendment fees from both the supplier and Wanderlust Australia. Amendments within 14 days of departure may be treated as cancellations.

4.3 Supplier Cancellations

In the unlikely event that a supplier cancels your booking, we will use reasonable endeavours to offer you alternatives or facilitate a refund from the supplier. Wanderlust Australia's liability is limited to the amounts received from the supplier.

5. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance at the time of booking. Travel insurance should cover trip cancellation, medical expenses, emergency evacuation, baggage loss, and travel delay. We can arrange travel insurance on your behalf upon request. Failure to obtain travel insurance is entirely at your own risk.

6. Passports, Visas, and Health Requirements

It is your responsibility to ensure that all travellers hold a valid passport (typically valid for at least 6 months beyond return travel) and obtain all required visas, entry permits, and vaccinations. Wanderlust Australia can provide general guidance but is not responsible for any consequences arising from failure to comply with entry requirements. Always check the Smartraveller website for up-to-date travel advisories.

7. Limitation of Liability

Wanderlust Australia acts as an agent for third-party suppliers. We are not liable for any loss, injury, damage, delay, or additional expense incurred as a result of acts or omissions of any supplier, force majeure events (including but not limited to natural disasters, pandemics, government actions, or industrial disputes), or your own actions. Our total liability to you shall not exceed the total fees paid to Wanderlust Australia for our services.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

8. Complaints

If you experience a problem during your trip, please report it to the relevant supplier immediately. Upon return, submit any complaint in writing within 30 days to [email protected]. We will investigate and respond within 14 business days.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on our website. Continued use of our services following any update constitutes acceptance of the revised Terms.
